Acceptable Use Policy
This Acceptable Use Policy ("Policy") sets out the rules that apply to everyone who uses dtcpilot, the AI operating system for direct-to-consumer brands (the "Service"), provided by BPI VENTURES GLOBAL – FZCO ("dtcpilot", "we", "us" or "our"). It forms part of our Terms of Service, and capitalized terms not defined here have the meanings given in the Terms.
The Service gives brands powerful tools: it generates creative, publishes ads, runs automation across ad accounts, takes payments, messages customers and processes orders. Those tools must be used responsibly and lawfully. Customers are responsible for ensuring that their Authorized Users, and anyone else who accesses the Service through their account, comply with this Policy.
1. Illegal and restricted products and services
You must not use the Service to advertise, sell, promote or facilitate:
- any product or service that is illegal in the place where it is sold, marketed or delivered;
- controlled substances, illegal drugs or drug paraphernalia, or prescription-only medicines sold without the required authorization;
- weapons, ammunition or explosives, where their sale or marketing is unlawful or prohibited by the relevant Connected Platform;
- counterfeit, replica or stolen goods, or goods that infringe the intellectual property rights of others;
- products that have been recalled, banned or declared unsafe by a competent authority, or supplements and ingredients that are prohibited where they are sold;
- unlicensed gambling, pyramid or multi-level marketing schemes, "get rich quick" offers, or other deceptive financial schemes; or
- any product or service that you are not legally permitted to sell, including because of a licensing, registration or age requirement you have not met.
2. Deceptive advertising and unlawful claims
Advertising created or published through the Service must be truthful, not misleading and properly substantiated. You must not:
- make false, misleading or unsubstantiated claims about a product's effects, ingredients, origin, price, availability or results;
- make unlawful health or medical claims, including claims that a product diagnoses, treats, cures, mitigates or prevents a disease, or unsupported weight-loss, anti-aging or performance claims;
- use fake scarcity, fake countdown timers, false "sale" pricing or undisclosed negative-option or subscription terms;
- publish fake reviews, ratings or testimonials, present paid or incentivized endorsements without the required disclosure, or misrepresent a typical customer's results;
- create advertorials or content presented as independent news or editorial content without clearly disclosing that it is advertising;
- falsely claim endorsement by, or affiliation with, a doctor, celebrity, public authority, media outlet or other brand; or
- impersonate any person, brand or organization, or misrepresent your identity or your relationship with any person.
3. Spam and unlawful messaging
The Service can send, or trigger through Connected Platforms, emails, SMS messages and other communications to your customers. You must:
- send marketing emails, SMS messages, calls and push notifications only to recipients who have given the consent required by applicable law, such as the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act in the United States, the GDPR and ePrivacy rules in Europe and the United Kingdom, and equivalent laws elsewhere;
- honor opt-outs and unsubscribe requests promptly, and include accurate sender identification and a working unsubscribe mechanism where the law requires it;
- respect quiet hours, frequency limits and do-not-call registries that apply to your messages; and
- not use purchased, rented, scraped or harvested contact lists, or send messages that are misleading about their sender, subject or purpose.
4. Circumventing platform policies
You must comply with the policies of every Connected Platform, including the advertising policies of Meta, TikTok and Google. You must not use the Service to:
- cloak or disguise landing pages, or show reviewers or automated systems different content from what users see;
- evade an account restriction, suspension or ban, including by creating or rotating accounts, business managers, domains, pages or payment methods to continue advertising after enforcement action;
- submit content designed to bypass automated review, for example by altering text or images to avoid detection of prohibited claims; or
- misrepresent your business, products or identity to a Connected Platform.
5. Fraud, financial crime and sanctions
You must not use the Service to:
- commit or facilitate fraud, including payment fraud, card testing, account takeover, refund or chargeback abuse, or the sale of goods you do not intend to deliver;
- launder money, finance terrorism or process payments for a third party without the payment processor's authorization;
- deal with, or provide services to, any person or country that is the subject of sanctions, in breach of applicable sanctions laws; or
- misuse the risk, fraud or reseller-detection features to unlawfully discriminate against customers.
6. Security and misuse of the Service
You must not, and must not attempt to:
- upload, transmit or distribute malware, viruses, ransomware or other harmful code;
- gain unauthorized access to the Service, another customer's data or workspace, or any system or network connected to the Service;
- probe, scan or test the vulnerability of the Service, or carry out penetration testing, without our prior written permission;
- scrape, crawl or extract data from the Service by automated means other than through APIs we make available;
- reverse engineer, decompile or disassemble the Service or its models, except where the law expressly permits it;
- overload, flood or disrupt the Service, exceed or circumvent rate limits or usage limits, or use the Service in a way that degrades performance for other customers;
- share login credentials, or resell, sublicense or provide access to the Service to third parties, without a written agreement with us; or
- use the Service to build a competing product or to copy its features or design.
If you believe you have found a security vulnerability, please report it to [email protected] and do not access or modify data that does not belong to you.
7. AI features and generated content
You must not use the AI features of the Service to create, edit or distribute content that:
- is unlawful, or infringes or misappropriates the copyright, trademark, publicity, privacy or other rights of any person;
- sexualizes minors in any way, or otherwise depicts, promotes or facilitates child sexual abuse or exploitation;
- is sexually explicit or pornographic;
- depicts a real, identifiable person, or imitates their voice, in a realistic way without that person's consent, including deepfakes of public figures, customers, employees or creators;
- harasses, threatens, bullies, defames or discriminates against any person or group, or promotes violence, hatred or self-harm;
- creates fake before-and-after images, fabricated product demonstrations, synthetic testimonials or synthetic "customer" footage presented as real; or
- is designed to mislead viewers about whether they are seeing a real event, person or result.
Content standards
All content generated through the Service is your responsibility once you publish or send it. Before publishing, you must review generated content for accuracy, check that every claim can be substantiated, add any legally required disclaimers and disclosures, and confirm that you have the rights to all people, brands, music, images and other materials it includes. Where AI-generated people, voices or scenes are used in a way that could mislead viewers, you must label them as required by law and by the policies of the platform where they appear. We may apply content filters and may decline to generate content that we reasonably believe breaches this Policy.
8. Child safety
We have zero tolerance for child sexual abuse material and for any content or activity that exploits or endangers children. We will remove such content, terminate the associated accounts and report it to the relevant authorities and organizations as required or permitted by law. You must not use the Service to target advertising for age-restricted products at minors or to collect personal data from children in breach of applicable law.
9. Harassment and harmful conduct
You must not use the Service, including its customer portal, support and messaging features, to harass, threaten, intimidate or abuse any person, including your customers, our staff or other users of the Service.
10. Enforcement
We may investigate any suspected breach of this Policy. Where we reasonably believe a breach has occurred, or is likely to occur, we may take any action we consider appropriate, including:
- removing, disabling or refusing to generate or publish the content concerned;
- pausing automations, disconnecting integrations or restricting specific features;
- suspending or terminating the Authorized Users or accounts involved, in accordance with the Terms of Service;
- reporting the activity to law enforcement, regulators, Connected Platforms or payment processors, and cooperating with their investigations; and
- seeking any other remedy available to us under the Terms or the law.
Where practicable and lawful, we will tell you about the issue and give you an opportunity to fix it before we take action. We may act immediately, without prior notice, where the breach is serious, involves illegal content or activity, or threatens the security or integrity of the Service, our other customers or a third party. We are not obliged to monitor your use of the Service, and our decision not to act on a breach does not waive our right to act on it or on any other breach later.
11. Reporting abuse
If you become aware of any use of the Service that breaches this Policy, including advertising, messages or content you believe were created or sent using dtcpilot, please report it to [email protected] with the subject line "Abuse report". Please include as much detail as you can, such as links, screenshots, the sender or advertiser, and dates. We review every report and treat the identity of the reporter as confidential, except where disclosure is required by law.
12. Changes to this Policy
We may update this Policy from time to time to respond to new risks, legal requirements or changes to the Service. We will post the updated Policy on this page with a new "Last updated" date and, for material changes, notify account owners as described in the Terms of Service.
